Terms of Service

Welcome to trip-share.com, offsites.do, retreats.do, our related domains, mobile applications, and connected services (together, the “Service”). The Service is operated by Tripshare LLC (“Tripshare”, “we”, “us”, or “our”). By accessing or using the Service, you agree to be bound by these Terms of Service (“Terms”). Please read them carefully.

1. Service Overview

Tripshare LLC provides tools for private, event-based travel coordination and itinerary management. The Service helps users coordinate stays, rides, flights, schedules, notes, messages, activities, imported booking confirmations, events, retreats, offsites, celebrations, and related logistics. We may also provide access to curated trip offers, negotiated group rate blocks, advisor-secured stay options, itinerary collaboration tools, and concierge-style coordination services through travel expert partners.

2. Eligibility

You must be able to form a binding agreement to use the Service. If you use the Service on behalf of an organization, event, company, family, group, or another person, you represent that you have authority to do so. The Service is intended for adults and is not directed to children.

3. User Responsibilities

You are responsible for the information you provide and for your interactions with other users.
You agree to use the service only for lawful purposes and in accordance with these Terms.
Accurate trip data: When adding or importing travel details, you are responsible for providing accurate information. The Service does not book or ticket flights.
Travel Advisors and Client Coordination: If you are a travel advisor (including Fora travel advisors or Founders Circle members) creating or coordinating itineraries for clients, you represent that you have authority to input itinerary details on their behalf. You remain responsible for maintaining your independent professional relationship with your clients.
Booking data license: By submitting booking confirmations, itineraries, messages, notes, schedules, requests, or other trip details, you grant Tripshare LLC a non-exclusive, worldwide, royalty-free license to host, process, display, transmit, and use that information solely as needed to provide, secure, support, and improve the Service and related travel coordination features.
You are responsible for your own safety and conduct when arranging or participating in shares (rides, rooms, etc.).
You agree to communicate respectfully with other users in all chat channels and not to share sensitive personal information of others without consent.
Live location sharing: "Live" is an opt-in feature that shares an approximate landmark or neighborhood, not your exact address, with your trip group for up to one hour. You are responsible for deciding when it is appropriate to share your location, and for ending sharing early if you no longer want to. Live location sharing is a convenience feature for trip coordination — it is not a safety, emergency, or tracking service, and should not be relied on as one.

4. No Endorsement or Screening

Tripshare LLC does not screen, endorse, or guarantee any users, rides, rooms, flights, accommodations, events, plans, or trip arrangements. All arrangements are made at your own risk. Certified advisors, travel suppliers, and third-party booking providers are separate entities subject to their own professional standards, policies, and terms.

5. Prohibited Conduct

Use the service for any unlawful or harmful purpose.
Impersonate any person or entity.
Harass, threaten, or harm other users.
Post false, misleading, or inappropriate content.
Solicit personal information from anyone under the age of 18.
Use the chat functionality to send spam, offensive content, or anything unrelated to trip coordination.
Attempt to bypass security controls, scrape the Service, disrupt the Service, or access information you are not authorized to access.

6. Account Security

If you create an account, you are responsible for maintaining the confidentiality of your login information and for all activities that occur under your account.

7. Termination

We reserve the right to suspend or terminate your access to the Service at our discretion, without notice, for conduct that we believe violates these Terms, creates risk, or is harmful to other users, Tripshare LLC, or the Service.

8. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not guarantee the accuracy, completeness, or reliability of any content or user.
We are not responsible for any loss, injury, or damage resulting from your use of the service.
Travel information, availability, rates, schedules, and offers may change and should be confirmed with the relevant provider before relying on them.
Live location sharing depends on device GPS accuracy and connectivity, is only visible to your trip group while active, and is not a substitute for emergency services. In an emergency, contact local emergency services directly.
No warranty against data loss: We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any trip details, itineraries, messages, notes, photos, imported booking confirmations, or other content you submit, store, or transmit through the Service (“your content”) will be preserved, backed up, or free from loss, corruption, deletion, or unauthorized access, whether caused by technical failure, service interruption, our data retention practices described in Section 13, account termination, or any other cause.
You are responsible for your own copies: You are solely responsible for maintaining independent copies of any content that is important to you. We have no obligation to retain, recover, or restore your content, and we are not liable for any loss or unavailability of your content, however caused.

9. Limitation of Liability

To the fullest extent permitted by applicable law:

Tripshare LLC and its affiliates, officers, directors, employees, contractors, and agents (the “Tripshare Parties”) shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, goodwill, data, or use, arising out of or relating to your access to or use of, or inability to access or use, the Service or any content (including loss, corruption, or deletion of your content), whether based on warranty, contract, tort (including negligence), strict liability, statute, or any other legal theory, and even if we have been advised of the possibility of such damages or if a remedy set out in these Terms is found to have failed its essential purpose.
In no event will the Tripshare Parties’ total aggregate liability arising out of or relating to these Terms or the Service exceed the greater of (a) the amount, if any, you paid Tripshare LLC for use of the Service in the twelve (12) months before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).
These limitations apply regardless of the cause or form of action, including data loss or corruption, service interruption or unavailability, or unauthorized access to your account, trip boards, or content.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the above limitations or exclusions may not apply to you. In those jurisdictions, our liability is limited to the greatest extent permitted by applicable law.

10. Indemnification

You agree to indemnify, defend, and hold harmless the Tripshare Parties from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees and costs, arising out of or in any way connected with: (a) your access to or use of the Service; (b) your content or the content of anyone using your account; (c) your violation of these Terms; or (d) your violation of any rights of a third party, including another user.

11. User-Created Content, Chat, and Messaging

The Service provides user-created content and messaging features for trip coordination. By using these features, you acknowledge that:

Messages, notes, comments, reactions, requests, and other content are created by users, not Tripshare LLC.
You are responsible for the content you submit and for having permission to share information about others.
We reserve the right (but have no obligation) to monitor, review, and remove messages that violate these Terms or our community guidelines.
Trip organizers or participants may see information you share according to the privacy settings and context of the feature.
Community and Cohort Channels: The Service may offer community group channels (such as the Founders Circle channel for verified travel advisors) to facilitate collaboration, roadmap discussions, and feedback directly with the founding team and peers. Messages in community channels are visible to all enrolled members of that cohort.

12. Curated Offers & Booking Services

By using our curated trip offers, group rate blocks, or concierge services, you agree to share your request details with our travel experts, certified advisor partners (such as Fora), booking providers (such as Booking.com), and hotel brands or properties involved in fulfilling your request. Responses and offers may be sent via email, private chat, or surfaced directly on the platform. Please note:

Stay Offers: Certified advisors, booking providers, hotel brands, or individual properties may negotiate, provide, or secure rates on an "as is" basis. Confirmation links for secure checkout may be provided by these parties (e.g., Fora secure site, Booking.com, hotel brand, or property checkout). Tripshare LLC does not process stay payments directly.
Flight Schedules: Flight search may be provided via third-party APIs (such as Duffel) for schedule lookup only. Tripshare LLC does not book or ticket flights, process flight payments, or act as a flight booking intermediary.
No Fulfillment Liability: Tripshare LLC is not responsible for the fulfillment, quality, safety, or availability of offers provided by third-party partners. Any bookings made are subject to the terms and conditions of the respective provider.

13. Data Retention & Trip History

To protect member privacy, Tripshare LLC maintains a "Privacy-First" data retention policy. We generally limit the retention of event-specific coordination data (including chat messages, ride requests, room requests, personal itineraries, and flight details) once the associated event has concluded.

Retention for Accounts: Users who create a registered account may retain their trip history for future reference. In such cases, coordination data associated with your account will be preserved until you request its deletion. For non-registered participants, data may be removed periodically as part of our data minimization efforts; additionally, access to specific trip boards may be revoked after a designated period determined by the trip organizers following the conclusion of the event.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on our website. Your continued use of the service constitutes acceptance of the updated Terms. Your data will remain subject to the purging policy in effect at the time of the event.

15. Intellectual Property

All content included on this site, such as text, graphics, logos, images, and software, is the property of Tripshare LLC or its content suppliers. Reference to any specific commercial products, processes, or services by trade name, trademark, manufacturer, or otherwise does not necessarily constitute or imply its endorsement, recommendation, or favoring by Tripshare LLC. Hotel names, logos, booking platform names, and other trademarks (including but not limited to Fora, Booking.com, Expedia, Hilton, Marriott, Hyatt, IHG, and other hotel or travel brands) are the property of their respective owners.

16. Apple App Store Terms

If you downloaded our iOS app from the Apple App Store, you acknowledge that these Terms are between you and Tripshare LLC, not Apple. Apple is not responsible for the Service or its content, has no obligation to provide maintenance or support for the Service, and is a third-party beneficiary of these Terms as they relate to your use of the iOS app.

17. User-Created Content and Trip Limits

Users may create their own trip events and invite others. To prevent abuse of the system and ensure optimal performance:

The maximum duration for any single trip or event is limited to 90 days.
We reserve the right to complete or remove inactive trips or those that violate our content policies.
